民族自治地方自治权刍议
内容摘要
民族区域自治制度是我国宪法确立的三大基本政治制度之一,是我国宪政体制的有机组成部分。它是中国共产党运用马克思主义民族理论和国家结构理论,结合中国具体国情,在长期的革命过程中确立的一项重要的宪政制度。它在实践中取得了很大的成功,但也存在一些问题,其中最为主要的表现就是民族区域自治权的行使和落实问题。民族区域自治权作为民族区域自治制度的核心和关键,是衡量是否达到真正民族区域自治的唯一标准,对于民族区域自治制度的落实和完善具有极其重要的意义。当今世界各国对于民族问题的处理,不管是采取联邦制还是区域自治、文化自治,其总体的精神是在确保国家统一前提下,赋予少数民族以某种自治权,使其能够得以自主的处理有关本民族事务。
