证明标准是指证明责任被卸除所要达到的范围和程度, 它实际上是在事实裁判者的大脑中证据所产生的确定性或可能性程度的衡量标尺,也是负有证明责任的当事人最终获得胜诉或所证明的争议事实获得有利的事实裁判结果之前,必须通过证据使事实裁判者形成确信的标准。因证明标准本身具有的抽象性、模糊性和在适用中的主观性等特点,导致其在实践中很难把握;加之立法上指导思想的模糊和制度设计上的不系统,增大了司法实践中操作的难度。而我国对于民事诉讼证明标准的规定还存在不尽合理的地方,这些不合理之处对我国的法律体系的进一步完善有一定的影响。因此,完善民事诉讼证明标准对于我国司法体系的完善以及司法效率的提高有着重要的意义。本文首先分析了民事诉讼证明标准的概念、特征、法律意义和理论基础,进而比较分析了大陆法系和英美法系中民事诉讼证明标准的差异与相通之处,在此基础上剖析了我国民事诉讼证明标准的现状以及存在的问题,并就如何重构我国民事诉讼的证明标准提出了合理化建议。

Abstract
Standard of proof means the burden of proof to be dropped by the scope and extent to be achieved, actually it is a certainty or possibility level of measuring scale made by the evidence which in the fact judge’s brain . It is also the standard for the party to provide evidences to make sure the fact judge agree before the party ultimately have an effect results or the proved disputes fact obtain a favorable merit. Due to the abstraction fuzziness and subjectivity in the application characteristics in standard of proof itself, it is difficult to grasp in practice, combined with the fuzzy guiding in enact law and non-system regime design, enlarges the difficulty in judicial practice operation. And there are many unreasonable things about the provisions of the civil standard of proof in China, and it has some bad influence for China to further improve the legal system.
