摘要
随着我国经济的快速发展,我国的融资租赁业务获得了较为快速的发展。要想使得融资租赁业务继续保持较快的增长速度,就需要重视融资租赁合同的转让问题,这是因为融资租赁合同属于一种较为新型的租赁合同与独立性较强的合同。然而在现实生活中,融资租赁合同转让却存在着较多的法律问题,这是因为融资租赁是综合贸易、融资和融物为一体的,并且现阶段,中国关于融资租赁合同转让的相关制度不够健全,同时法律规定中没有关于融资租赁的登记、类型、违约救济等方面的问题,更多的只是融资租赁交易的相关内容。
由于缺乏相关的法律保障,所以,这就在较大程度上阻碍了融资租赁行业的发展。因此,本文主要对融资租赁合同转让相关概念进行阐释;其次对其中的法律问题进行研究,最后,提出了有关的对策。

Abstract
With the rapid development of China's economy, China's financial leasing business has a rapid development. In order to make the financing lease business continued to maintain a rapid growth rate, need to pay attention to the transfer of the financing lease contract, this is because the financing lease contract is a relatively new lease contract with a strong independent contract however, in real life, but there is a financing lease contract for the transfer of more of the legal issues, this is because the financing lease is prehensive trade, financing and financial integration, and at this stage, the related system China on financing lease contract transfer is not perfect, and no law on Financing lease Registration, type, breach of relief and other aspects of the problem, more than just the content of financial leasing transactions
Due to the lack of legal protection, so this is related, in a large extent hindered the development of the financial leasing industry. Therefore, this article mainly explains the transfer of related concepts of financial leasing contract; secondly on the legal issues of research, finally puts forward relevant countermeasures.
