摘要:国家经济迅速发展。诚信乃立身之本。在关于市场经济的健康成长环节,保险对其经济有着保驾护航的作用。保险的种类分明别类,但是相对于海上保险制度而言最重要的就是最大诚信原则。当下我国对于这一原则的法律规定并不完善,对于整个行业大发展也不能起到有效的促进作用。
本文我们将对最大诚信原则的历史沿革进行探讨,并且深入分析其产生的原因和具体的要求。从而我们知道最大诚信原则最早来源于古代罗马,但是其应用于海上保险却是在英国。最大诚信原则的产生可以说是为了交换的方便和最大限度的保护其海上保险行业的稳定发展。同时我们研究其应用的具体要求,在应用中投保人双方都应该承担一定最大诚信这一义务。之后我们结合具体案列对最大诚信原则在海上保险中的应用进行了探究分析。从而知道这一原则的应用是分情况和场合的,而不是一成不变的。最后我们分析了我国法律关于这一原则的规定,和现实中存在的问题,并且给出了解决之道。完善立法,提高相关人员的素质是其重中之重。
