浅议情势变更原则的适用

摘要:情势变更原则是合同履行中的重要原则,许多国家的合同法都有相应的规定,我国现行法律中并未明确规定这一原则。文章认为情势变更原则在我国的确立有其必要性,而其适用问题是理论和实践结合最密切的部分。文章分五个部分对情势变更原则的适用问题进行阐述。第一部分简单介绍了情势变更原则的内涵,第二部分分析了适用该原则的条件,第三部分是对适用情势变更原则的法律效果的论述,第四部分是对该原则适用中的若干问题的解析,第五部分为我国确立情势变更原则的意义、面临的障碍及其排除。

Abstract:The Circumstance Change Principle is a important principle of contract implement medium, all have the homologous provision in law rulings of many countrys. Current law of our country in did not rule this principle definitely. This article thinks that the Circumstance Change Principle really signs it in the our country necessity, and the application of the principle is the part on which its theory and practice are most closely integrated. The article is divided into five parts, elaborating the problem on the Application of Circumstance Change Principle. The first part introduces the content of this principle in brief. The second part analyzes the condition of appling that principle. The third part is a treatise of the law result to apply the Circumstance Change Principle. Four-part cent is a resolution about some problemses on the application of the principle.
