高等学校行政主体地位初探

摘要: 长期以来, 高等学校的法律地位模糊不清, 学校仅具有民事主体资格。重新界定高等学校在新体制下的行政法律地位, 即“公务法人”地位, 运用法人制度来处理高等学校与政府、教师、学生和社会的关系, 是实现“以法治教”的重要途径。

Abstract : For a long time , t he legal status of t he institutions of higher learning has been vague. The in2
stitutions enjoy only t he qualifications of civil subject . The realization of genuine rule of law requires , under t he new system , reconsideration of t he institutions’administrative legal status , t he status of“legal person of official business ,”and proper management of relationships between t he institutions and government , faculty , students
as well as society.

教育活动是人类社会生产和社会生活的重要组成

人依法享有的权利, 也是向社会应尽的义务。法律成
