罚金刑执行中的问题 成因及对策研究——以湖南某中级法院罚金刑执行为实证视角.docx

摘 要
随着市场经济的发展以及刑罚轻缓化的国际趋势,罚金刑日益受到各国刑事立法与司法的重视,适用范围也越来越广。然而,罚金刑的适用中也不可避免地出现了诸多问题,尤其是罚金刑执行难的问题。这不仅是我国刑事司法面临的难题,也成为困扰世界各国的一个普遍性问题。本文立足于法院罚金刑执行工作实际,在注重调查研究的基础上,对罚金刑执行中的问题及其产生的原因作一探讨,并就该问题的解决提出初步设想。
全文共分三个部分。第一部分: 罚金刑执行中的主要问题。该部分主要通过实证研究,为探讨解决当前法院罚金刑执行难问题奠定基础。罚金刑执行中的问题既包括法院自身的问题,也包括司法机关之间的协作问题,还包括被执行人引起的问题及社会大环境的问题等。第二部分:罚金刑的执行难原因。针对法院罚金刑执行中存在的主要问题,结合罚金刑执行司法实践,本文从我国的思想与文化、立法层面、司法层面等多角度深刻分析了执行难存在的原因;第三部分:罚金刑执行难的解决对策。在参考有关罚金刑执行问题研究成果的基础上,本文提出要从根本上解决我国罚金刑执行难问题,可分局部性缓解、全国性缓解、根本性解决三步进行。本文着重探讨第一步: 一是法院自身切实加强和改进罚金刑执行工作;二是法院强化与公安、检察、监狱的协作;三是法院与国有资产管理机关展开协作,建立健全罪犯财产的确权、析产制度; 四是提高全社会对罚金刑执行重要性的认识。然后,通过着手实施第二步、第三步, 最终从根本上解决罚金刑执行问题。

Abstract
With the development of the market economy, as well as the international trend of gently penalty . Fine penalty is considered highly by the criminal legislation and justice all over the the application rate of fine is more and more high. However there have been many problems during the application of Fine penalty inevitablely. Especially the problem of uting difficulty is still very serious in China and whole world. This paper is established on the practice of the execution of fine penalty. On the base of the investigation and study, it try to discuss the problems of the fine penalty during the execution, the cause of fine penalty and make suggestions on resolving it.
The paper is made up of three parts. Part I:the main issues in the of execution of fines penalty. Through investigative demonstration, the part provides a good foundation to discuss how to solve the current difficulty of the execution of fine penalty. The problems not only include the problems from executive department itself,but also include the collaboration between the judicature, and the problems caused by executants.
