法律金融安全叶片理论分析.docx

自20世纪80年代特别是90年代起,大规模的金融危机频繁爆发,震惊世人,人们防范金融风险的观念直接提升到维护金融安全的迫切,加强金融监管形成呼声,法律受到青睐,几乎提到金融安全必提到加强法制建设。然而对于法律与金融安全的关系缺乏深入研究,究竟什么是金融安全,法律与金融安全是否存在直接的更深的关系,这些问题很少有人作较为深入的分析。
本文试图深入研究法律与金融安全之间的关系,填补这方面的理论空白。主要研究的视角和方法:经济学理论,哲学思考,法学理论,历史分析,图示分析等。第一章通过金融危机的历史回顾,引出加强有效监管的时代命题,填补法律和金融安全之间关系研究空白的迫切性,表明本课题研究的意义。第二章论述法律金融安全叶片理论,由金融安全文明说、金融恶化惯性、法律金融安全和法律金融安全叶片图分析构成逻辑框架。第三章运用上述理论对维护中国法律金融安全作思考,从金融安全和法律两方面试图将该理论应用于实践,也是对该理论的检验。本文的创新之处有法律金融安全叶片理论,金融恶化惯性,法律金融恶化加速效应和法律金融安全良性互动效应等。

ABSTRACT
The unprecedented size financial crises broke out frequently since 1980’,especially since 1990’,which mon people,have raised the level oftaking financial
risk precautions directly to safeguard financial security in appeal for strengthening financial supervisory while law is in their good graces wherever
financial security is mentioned s仕engthening the legal system is almost bound to be touched the filiation between law and financial security is short of deep research simultaneously and the meaning of financial security or ifthere is more immediate or deeper filiation between law and financial security,these questions lack quietly deeper analyses。
The treatise tries to research into the filiation between law and financial security
