和VCrO《反倾销协定》对倾销幅度的规定后,指出懒销协定》的相关规定存在缺陷。第一,缺少对使用“归零法”的限制。欧美一些国家在计算倾销幅度时没有合理对待“负倾销幅度”,把“负倾销幅度”当作零倾销,
从而提高了实际的倾销幅度。第二,饭倾销协定》对次等品和不合格品在
确定倾销幅度时没有给予合理的对待,也因此不合理地抬高了倾销幅度。
第三,应该废除对间接销售费用的不对称处理方法,禁止从结构出口价格
或者比较市场价格中自动扣除间接销售费用。
经过E述分析论证,笔者认为vcro(《反倾销协定》在实体规范上存在较大的缺陷,导致其未能在国际贸易自由化和国内产业利益保护之间达成平衡,进而导致其不可避免地成为贸易保护的工具。因此,在不可能完全废弃vci'o《反倾销协定》的前提下,在维持其原有基本概念、原则的基础上,
对协定的实体规范进行修改和完善,使其更加公正和透明,就成为现实的必然遗择。
