我国精神病人强制医疗制度探析
摘要
精神病人带来的社会问题,既是法律问题,又属于社会公共卫生问题,要想从法律层面解决精神病人带来的严重社会问题,仅仅凭借法律是不够的,还必须要借助卫生医学的力量,借助科学的力量,因为最终我们要解决的问题并不是精神病人,而是精神疾病,在精神病人强制医疗制度下,我们每个人都应当明确地认识到一点:强制是手段,医疗才是目的;强制性地限制人身自由等权利只是手段,通过治疗回归社会才是目的。而就我国目前情况来看,强制医疗存在着诸多不完善,需要医疗的精神病人得不到有效治疗。本文从强制医疗制度的性质和特征入手,明确了精神病人强制医疗中所存在的主要问题,并从立法角度提出了相关的建议。

ABSTRACT
Social problems brought by the legal problems of mental patients, not only, and belongs to the social public health problem, to solve the serious social problems brought by mental patients from the aspect of law, only by virtue of the law is not enough, must also be with the help of health medical forces, with the help of science strength, because in the end we want to solve the problem is not the spirit the patient, but mental disease, forced in the mental patient medical system, each of us should be clearly aware of : pulsory means, health is the aim; mandatory restriction of personal freedom rights is only a means, through treatment and return to society is the aim. And the current situation in our country, pulsory medical treatment exists many imperfect, need spiritual care is not effective treatment. This paper starts from the nature and features pulsory medical treatment system, the mental patient to force major problems in medical, and related suggestions are put forward from the angle of legislation.
