“电子眼”执法证据和程序问题的研究

摘要

随着“电子眼”在交通违法行为处罚中的广泛使用,人们对“电子
眼”执法的质疑也随之而来,以及由此带来的法律诉讼案件快速增加。
本文从“电子眼”作为交通违法行政处罚依据的角度入手,以法律理论
为基础,结合案件实例,按照提出问题、分析问题、解决问题的思路,
在我国目前法律框架内,对电子眼执法涉及的有关法律法规进行梳理,
探索“电子眼”应用中的法律问题。文章重点分析了“电子眼”作为行
政处罚证据的不足,以及在履行告知义务、执法程序公开和被处罚人申
辩权利保护等方面存在的诸多症结和问题,并依此提出了自己的改进建
议。文章分为三个章节:第一章是问题的提出,通过“电子眼”产生的
案例,揭示出在“电子眼”执法中存在的主要问题和争议;第二章对“电
子眼”作为行政执法证据进行分析,阐述了“电子眼”证据和执法行为
的合法性,论述了“电子眼”证据作为行政处罚依据的充分性;第三章
对“电子眼”在执法程序中存在的问题进行分析,从“电子眼”的告知
义务、执法程序的公开和被处罚人申辩权利的保护三个方面进行了分析
论述。

EVIDENCE OF LAW ENFORCEMENT AND RELEVANT
PROCEDURES



ABSTRACT


With the wide use of "electronic eyes" against traffic violations,the
suspicion of its veracity also arises, along with the rapid increase of lawsuit.
In line with the current legal framework of China, this article is written from
the angle of using "electronic eyes" against traffic violations and on the basis
of legal theory. It bined with cases and with the process of raising,
analyzing and solving problems. It focuses on the legal issues of the
application of "electronic eyes" as well as an analysis of the defects in using
"electronic eyes" as evidence of administrative penalties and it also embraces
the problems in carrying out the obligation of informing relevant people of
their violations, the law enforcement procedures and so on. The author puts
forward some proposals and advice to address or minimize these issues.
This article posed of three charters. The chapter 1 presents
problems, main debates and argument which are brought about by the
application of "electronic eyes". Chapter 2 analyses and discuses the validity
and sufficiency of the "electronic eyes" as proof of administrative punishment.
Chapter 3 explores some issues which occurs when the "electronic eyes"
work .
