.摘要
随着进出口国际贸易争议越来越多,在国际贸易过程中发生各种争议后的仲裁和执行的法律风险也越来越大,如何通过仲裁和执行维护自己的合法权益并把随之的法律风险减少到最低水平,中国企业常常感到一筹莫展,但企业不可能因上述仲裁和执行法律风险而放弃维护自己的巨额经济权益。为尽可能地减少中国企业在国际贸易争议发生后的法律风险以使能勇敢跨出国际仲裁和执行的第一步,结合所办一起经典的中、美企业国际贸易仲裁和执行案例,采用比较研究和法社会学的方法,就中国企业在中、美国际贸易争议申请仲裁和执行过程中可能会遇到的跨国仲裁和异国申请承认和执行仲裁裁决等诉讼法律风险作详细分析并给出相应的应对策略,并就中国企业申请国际仲裁后向美国联邦地方法院申请承认外国仲裁裁决和执行与国内的申请执行程序差别作详细比较,以使企业的上述仲裁和执行律风险减少到最小程度,同时也能在一定程度上填补我国法律界在国际贸易争议仲裁和执行法律风险方面研究的不足,希望能给某些企业在国际贸易争议中如何应对仲裁和执行法律风险提高适当参考。

ABSTRACT
Along with the international import and export trade disputes more and more, the arbitration and the implementation of legal risk is more and more big. How to reduce the legal risk to a minimum level by arbitration and enforcement to safeguard their legitimate rights and interests during the international trade process is hard to many Chinese enterprises, while the enterprise is not possible to give up maintaining their own huge economic interests only for the above legal risk. To make the Chinese enterprises to take the first step of international arbitration and enforcement bravely, the author made a detailed analysis and give some advice on how to reduce the legal risk during the process of international arbitration and enforcement for international trade dispute through a classical international trade arbitration and executive case by method parison research and Sociology of law, mainly on the international trade between China and USA. Then he make a detailed parison between the international arbitration recognition and the domestic process. By the above study not only is the legal risk reduced to a minimum level, but also can fill the insufficient research of our country in the international trade dispute arbitration and enforcement risk , furthermore it can give some enterprises in international trade some appropriate reference on how to deal with the international trade arbitration and enforcement law risk.
