研究国际条约在国内的适用问题,具有重要的理论和现实意义。本文通过对国际条约在各国适用的理论和实践的分析,详细地阐述了条约在我国的适用方式,效力等级和直接效力等问题。
近年来,国际条约在我国的适用问题,随着我国缔结或参加的条约在数量上的迅速增加,以及条约实践问题的日益突出,越来越引起有关部门的关注,条约是通过什么方式被接受为国内法的一部分?条约与国内法孰为优先?个人能否在国内法院直接援用条约,维护自己的权益?本文试图结合条约在各国适用的理论和实践,详细阐述条约在我国适用的法律问题。
