对醉驾应否一律入罪的法律思考
摘要
随着社会经济的发展,当今社会已经进入了汽车的时代,交通事故时有发生,造成了大量的人员伤亡和财产损失,由此引发了日益严重的社会问题。由于醉酒驾驶、酒后驾车导致的事故比重越来越大,造成的危害也越来越严重,引起了全社会的广泛关注。醉酒驾驶和酒后驾驶入罪的呼声越来越大。根据违法的成本与利益比较,“醉驾入罪”是人心所向,大势所趋。
2011年2月25日通过,5月1日起施行的《刑法修正案(八)》顺应了历史的变化,增加了对醉驾的刑罚处罚。但是根据最高法院副院长张军的“醉驾并非一律入刑”的言论,危害社会行为情节显著轻微危害不大的,不认为是犯罪。那么,究竟怎样的情形才会被认定为犯罪?醉驾应否一律入罪呢?本文对醉驾入罪及相关法律问题予以分析、探讨,以求明析之争议。
