摘要
试用期为劳动法上之特色制度,是劳动合同制度之组成部分。2008年正式实施《中华人民共和国劳动合同法》(以下简称《劳动合同法》)对试用期制度比《中华人民共和国劳动法》(以下简称《劳动法》)做出了更加具体的规定。但是这些规定仍存在较多缺陷。在当前就业压力日益严峻的国情下劳动关系双方当事人地位严重失衡,在实践中用人单位滥用试用期侵犯劳动者合法权益的现象仍然比较突出。
本文共分为六大部分,第一部分主要讲述试用期的概念和劳动者在这一时期内应享有的权利;第二部分着重分析当前我国有关试用期的立法;第三部分叙述劳动者在该时期内权利受到侵犯的几种表现;第四部分讲解我国试用期内劳动者权利保护存在的问题;第五部分介绍国外对该期间的立法规定及对我国的借鉴;第六部分是通过以上分析提出保护试用期内劳动者权利的一些建议和措施。

ABSTRACT
Probation system is featured on the labor law , is an integral part of the labor contract system . 2008 promulgated the " People's Republic of China Labor Contract Law" ( hereinafter referred to as the "Labor Contract Law" ) on the probation system than the " People's Republic of China Labor Law" ( hereinafter referred to as the "Labor Law" ) to make a more specific provisions. But there are still many defects in these provisions . Status of labor relations the parties a serious imbalance in the current situation increasingly severe employment pressure , in practice, the phenomenon of abuse of the trial period the employer violated the legitimate rights and interests of workers are still outstanding.
This paper is divided into six parts , the first part focuses on the concept of rights and workers within the probation period should enjoy this period ; second part focuses on analysis of the current legislation of the relevant probation period ; workers in the third part describes the period the rights have been violated several performance ; fourth part to protect the rights of workers to explain the existence of the trial period the problem ; part V describes the legislative provisions and abroad during the reference to China ; sixth part is made
by the above analysis try some suggestions and measures to protect the rights of workers during the period .
