内容摘要
在所有的诉讼中,法律经解释方可适用,刑事诉讼也不例外。法律的解释方法包
括文义解释、历史解释、目的解释、体系解释、合宪性解释等,而体系解释作为众多
法律解释方法中的一种,是以法律条文在法律体系中的地位,即依照其编、章、节、
条、款、项的前后关系位置,或相关法条的法意,阐明法律条文的意旨的解释方法,
其在刑事审判过程中具有重要的作用。刑事审判中的体系解释有其自身的功能及规
则,目前我国刑事审判中存在着体系解释的有权主体不够合理、法官运用体系解释方
法的意识不强、对体系解释方法运用的能力不足、法官解释法律的解释技术不发达等
主要问题。建议通过明确法官的法律解释权、加强法官队伍的建设、增强法官法律解
释的能力、完善法官法律解释技术的运用等方法加强体系解释方法在我国刑事审判中
的应用。

by applying ability inadequacy, judge's interpretation of legal interpretation technique is underdeveloped
wait for main suggests the adoption of clear judge's power of legal interpretation,
strengthening the team construction, enhance the ability to improve the interpretation of law, legal
interpretation technology methods of strengthening the system interpretation method in criminal trials in
China application.
