摘要
刑事第二审程序作为普通救济程序是刑事诉讼的独立程序,也是整个刑事诉讼程序
重要环节。它对于保证法律的正确运用,维护司法公正,具有重要的意义。但由于我国
的刑事诉讼法中关于刑事第二审程序的相关的一些法条过于抽象、模糊,缺少可操作性,
造成了在司法实践中出现许多和立法原意完全相反的局面。不仅法条本身的作用没有发
挥,而且也严重影响了刑事二审出程序作用的发挥,严重影响了程序的公正性。另外,
我国刑事第二审程序中实施的一些原则并不符合现代法治理念的要求,不仅程序的公正
性得到损害,而且司法效率较低,浪费了有限的司法资源。我国的刑事第二审程序的不
但对被告人救济作用没有充分发挥,而且也影响了整个刑事诉讼程序的程序公正性。因
此,很有必要从理论上加深对刑事二审程序的研究分析,并逐步对我国的刑事二审程序
进行修改、完善,使我国的刑事二审程序的救济作用得以充分的发挥。
本文正文共分为四部分,分别为刑事二审程序的概述、国外未生效裁判上诉程序的
考察、我国刑事二审程序存在的问题和完善我国二审程序的对策。首先从审级的概念入
手,分析“第二审程序”的概念和它在整个诉讼程序的地位,对其本身的价值和功能作
了详细的阐述。然后,为借鉴国外刑事二审程序的先进经验,以英、美、法、德分别作
为两***系的代表,对四国的刑事上诉程序进行分析探讨。继而列举出我国刑事二审程
序在立法和司法实践存在的问题,最后针对这些问题提出了笔者的一些建议。

Abstract
Criminal procedure of second instance, as a general relief program is an independent
process,in criminal proceedings is the important part of criminal proceedings. It is of great
significance for ensuring the correct application of the law, safeguard judicial justice,
However, due to some law related to China's Criminal Procedure Law of criminal procedure
of second instance is too abstract, vague, lack of maneuver ability, resulting in judicial
practice and legislative intent of pletely opposite situation. Not only the law itself the
role does not play, but also seriously affected the second criminal trial program to play the
role, has seriously affected the fairness of the program. In addition, the implementation of
some of the principles in China's criminal procedure of second instance does not meet the
requirements of the modern concept of the rule of law,
