JIANGXI AGRICULTURAL UNIVERSITY《电子商务法》期 末 论 文题 目:浅谈电子商务税收中的法律问题学 院:江西农业大学南昌商学院姓 名:李 彬学 号:09502128专 业:电子商务年 级:2009指导教师:陈琦2012 年 10 月江西农业大学南昌商学院 摘  要摘 要电子商务的产生及发展,可以说是世界各国自工业革命以来发生的最大的变化之一,它的迅猛发展对各国的经济发展既是一种挑战又是一种机遇。电子商务本身所具有的特殊性,以及与传统商务之间存在的差异,致使电子商务对传统税收理论、税法要素和税收管理造成冲击。借鉴世界组织和各国政府在解决电子商务税收的法律问题上所采取的办法及已取得的经验,我国应对电子商务条件下的税法原则和税法要素进行法律定位,以指导制定合理的电子商务税收政策和科学的管辖模式,并对电子商务税收问题采取一系列措施来应对冲击。电子商务的快速发展使电子商务交易成为商品贸易的主要手段,电子商务的特殊交易方式给传统税收体制及税收管理模式带来了巨大带挑战,如何解决关于电子商务税收征管过程中的征收、监控、管辖、管理等问题均依赖于税务法律的进一步完善。【关键词】电子商务 避税 税法完善 税收I江西农业大学南昌商学院 AbstractAbstractThe merce the generation and development, cansaying is the countries all over the world since since the industrialrevolution happened one of the biggest change, its rapid developmenton the economic development of all countries is a challenge and anopportunity. Electronic business itself is particularity, and thedifference between the merce, the merceto the traditional tax theory, tax law elements and the impact of taxadministration. Drawing on anizations and governments insolving the merce tax legal problems has taken on themeans and the already obtained experience, in order to deal with merce tax law under the condition of the principles andfactors of the tax law law orientation, in order to guide toestablish reasonable merce tax policy and scientificmode of jurisdiction, and the merce tax problem take aseries of measures to deal with the  rapid development of merce make electronic businesstransactions e the main means of merchandise trade, merce special way to trade to traditional tax system and taxmanagement mode has brought great belt challenge, how to solve merce tax collection and management in the process ofthe collection, monitoring, jurisdiction, the management aredependent on tax law further perfect.【key words】merce; tax avoidance; Tax law perfect; tax;II江西农业大学南昌商学院 目 录目 录一、电子商务税收的基本概念....................................................................................................... 1二、我国电子商务税收问题现状..........
