摘要: 随着我国反***工作的进一步深入,如何发挥刑罚的惩治和预防功能,对***、受贿犯罪正确适用刑罚,是立法机关和司法机关需要高度重视的问题。当前,我国***罪受贿罪法定刑设置存在很多问题,在一定程度上影响了打击和预防***受贿犯罪的成效。本文剖析了我国刑法典中***罪受贿罪法定刑设置存在的主要问题,如资格刑规定的缺位、生命刑规定的浪费、财产刑规定之不足、入罪数额标准不科学、刑罚幅度的外部不协调、刑度内部不协调、受贿罪的量刑比照***罪处理很不科学;最后提出了自己的完善建议。

Study on the Measurement of Penalty for Bribery and Corruption

Abstract: Along with counter-corruption work further thorough in our country, how to displays prevention function of penalty and bribery, correctly apply to the crime of penalty and bribery, is the problem which legislature and judicial authority needs to consider. Presently, the options of legally prescribed punishment of penalty and bribery in our country excites many problems, this circumstances have affected the efficiency of attack and the prevent penalty and bribery. This article analyzed main problem of the options of legally prescribed punishment of penalty and bribery in our country, such as, the vacancy of qualifications for punishment stipulation, waste of death penalty stipulation, insufficiency of the property punishment stipulation, the standard of punished amount is unscientific, exterior and interior uncoordinated of measurement of penalty, in contrast with corruption of offence, the measurement of penalty for crime of acceptance of bribes is not scientific. Finally author proposed own consummates suggestion.
