隋朝乡里制度浅探The study onRegulation ofXiang –LiInSui Dynasty宋文龙Song Wenlong西北师范大学文史学院College of Liberal Arts of Northwest Normal University二○,从隋文帝开皇元年春到开皇二年秋沿用的是北周基层管理制度;到隋朝开皇二年颁布《开皇令》规定,在京畿之内实施族、闾、保三级制及在京畿之外实施党、里二级制双轨并行;再到开皇九年颁布新制,推行不分京畿内外统一编制的乡、里二级制,都体现了隋王朝根据时局变化调整国家政策的实用立场。隋朝乡里制度研究课题可能有三个方面创新之处:第一,从史料记载可知隋朝乡里制度的法律所本在于隋令。而隋初开皇令的颁布时间为开皇二年秋八月,这也是隋初乡里制度开始正式颁布实施的时间。根据此判断,我们可以把隋朝乡里制度的实施分为三个阶段:(一)是开皇元年春二月到开皇二年秋八月,是筹备期。(二)是从开皇二年秋八月行新令到开皇九年春二月新制。(三)是开皇九年春二月直至隋亡。第二,对于隋朝乡里制度的渊源,笔者认为隋朝乡里制度的法律依据是隋令,探寻隋朝乡里制度的渊源就得从宏观上把握隋令制定的来源,再从微观上结合乡里组织的单条法令进行对比研究,这样将有助于全面系统的解释隋朝乡里制度的渊源。第三,学术界对于隋朝两京城区之内里坊和两京城区四郊的乡、里的考订成绩斐然,而对隋朝京畿之外州郡县的乡、里名称与地理位置考证方面关注不多,本文结合隋朝乡里制度的执行情况,对隋朝京畿之外州郡县的乡、里名称考证。关键词:隋朝;乡里制度;乡;里IIIAbstractThe Regulation of Xiang-Li in Sui Dynasty,From the first year of Emperor Sui Wendi open spring Kai Huang two years autumn follows the Northern Zhou villagegrass-roots management system.
