摘要摘要 2011年2月25日,第十一届全国人大常委会第十九次会议闭幕。经过投票表决,《刑法修正案(八)》正式通过。此次修正案中,讨论最多的也最受关注的就是新增危险驾驶罪这一罪名。对于危险驾驶行为的处罚之前主要适用行政手段,但由于近几年危险驾驶行为愈发猖獗,人民群众对打击此行为的呼声也逐渐高涨,考虑危险驾驶行为严重的社会危害性,此次修正案特新增危险驾驶罪,将其划入了刑法规制的范围,为预防与打击危险驾驶行为提供了法律依据,同时也迸一步保障了人民生命财产安全和社会的和谐稳定。目前,学术界对于危险驾驶罪理论的诸多问题观点不一,对危险驾驶罪理论的深入研究有利于更好的指导司法实践。本文立足于《刑法修正案(八)》对危险驾驶罪的规定, 采用分析和比较的论证方法,对危险驾驶罪这一新增罪名进行阐述和介绍,着重分析其罪名、犯罪构成、罪名之间的界限、立法完善等相关法律问题,对其中有争论的焦点问题进行界定,并提出一些自己的见解:例如本罪应该分定罪名;对于道路的认定应该从广义上理解,不能局限于道路安全法律法规的规定; 醉酒标准应坚持以酒精含量为主、意识和行动能力判断为辅;追逐竞驶行为人在主观上不需要具有赶、比的心理状态以及不需要以超速为前提;对本罪设置刑罚时,应在吸收国外先进立法经验的同时结合我国的具体实际情况等等。笔者以此论题作为自己的学位论文,依据我国实际情况,在前人理论的基础上对危险驾驶行为进行分析,并期望对预防和打击危险驾驶行为的实践有所助益。关键词:危险驾驶罪;构成特征;界限;立法完善。 I Abstract Abstract InFebruary 201,the 9thmeeting ofthe thNPC mittee,pleting itsagenda,the GreatHallof thePeople inBeij ing on theafternoonof afterthevote,passed theCriminalLaw Amendment m)”.
