苏州大学硕士学位论文犯罪嫌疑人人格尊严的宪法保护姓名:王延波申请学位级别:硕士专业:宪法学与行政法学指导教师:上官丕亮 201105 犯罪嫌疑人人格尊严的宪法保护摘要摘要人格尊严是世界各国宪法及国际人权公约所确认的基本权利或人权基础。我国宪法上的人格尊严作为一项基本权利,是指人因拥有区别于动物的尊贵庄严的地位,而应当受到尊重和人道待遇的权利,其核心内涵在于把人当人看。犯罪嫌疑人人格尊严之所以需要宪法保护,是由宪法保护的根本性决定的,也是保护犯罪嫌疑人人格尊严的必然要求和现实需要。对于犯罪嫌疑人的人格尊严,国家负有尊重和保障的义务,立法机关、侦查机关、检察机关和审判机关均是履行国家义务的主体。实现犯罪嫌疑人人格尊严的宪法保护,需要树立保护犯罪嫌疑人人格尊严的宪法意识,需要依宪立法加强对犯罪嫌疑人人格尊严的制度保护,需要依宪侦查和检察切实保护犯罪嫌疑人的人格尊严,需要依宪审判重视犯罪嫌疑人人格尊严的救济,需要尽快启动违宪审查程序制止对犯罪嫌疑人人格尊严的权力侵犯。关键词:犯罪嫌疑人人格尊严基本权利宪法保护国家义务作者: 指导教师: 王延波上官丕亮 The suspect’S constitutional protection ofhuman dignity Abstract Dignity isthefundamental rights or thebase ofhuman rights。recognized by constitutionofallthecountriesintheworldandtheinternationalhuman rights treaties.
