民族地区教育行政执法之分析研究.pdf

中南民族大学硕士学位论文 I 摘要温家宝总理在十届全国人大四次会议上指出:“教育是国家现代化的基石。把教育的发展优先放在战略地位,以人为本,要提高人的素质,必须将文化教育提上去,人的素质也才能够提上去”。此说不仅道明了教育关乎国家的兴旺发达,也道明了教育对国民素质提高的根本作用。如果说依法行政是依法治国的核心内容, 那么依法治教是推进我国民族地区教育事业发展的根本途径。本文的民族地区特指实行民族区域自治的地方。截至2004年底,全国共建立 155个民族自治地方,其中包括5个自治区、30个自治州、120个自治县(旗)。民族自治地方的面积占全国国土总面积的64%左右。 1民族地区是中华人民共和国的重要组成部分,所以,民族地区教育的发展,不仅仅是某个民族地区自身发展的问题,而且涉及到同整个国家教育的协调发展。在依法行政和依法治教越来越成为人们共识的今天,民族地区教育行政执法的现状从理论到实践都难以适应形势发展的要求,很多问题亟待解决。所以,加强对我国民族地区教育行政执法问题的研究,对于促进我国民族地区教育行政执法的依法行政和科教兴国战略具有重大的理论意义和现实意义。论文共分为四章:第一章绪论。该章主要包括:研究背景及意义;研究内容和方法;论文的创新之处。第二章民族地区教育行政执法概述。该章主要包括: 一、基本概念解读及阐释;二、民族地区教育概况及教育行政执法制度安排。第三章民族地区教育行政执法中存在的主要问题及成因分析。在民族地区教育行政执法中存在的主要问题包括:一、教育行政执法主体混乱;二、教育行政执法行为不规范;三、教育行政执法监督力度不够;四、教育行政执法人员整体素质水平不高;五、其他方面。第四章对策思考。主要从:一、完善执法依据;二、增强执法能力;三、完善监督机制;四、健全救济制度;五、提高执法人员素质等方面提出具体解决措施。关键词:民族地区教育行政执法问题对策中南民族大学硕士学位论文 II Abstract Premier Wen Jia-bao at the Fourth Session of the 10th NPC, said,Education is the cornerstone of the country's priority on the development of a strategic position, to enhance the quality of education must be elevated. the quality can also elevated.
