摘要摘要“标准不仅决定了我们对一个事物的批评,而且决定了我们对这个事物的理解,甚至决定了这个事物的存在,或者说,标准使我们有理由确定一个事物的存在情况。”而在证据法中,证明标准是裁判的尺度,是证据法中的核心和灵魂。我国学者毕玉谦曾指出:“多年来,证明标准问题始终是困惑我国民事诉讼对于案件事实认定的一大难症,时至今日,这一问题在理论研究和审判实务中并未得到根本解决,从而给我国诉讼法学界留下了一个明显缺憾。”因此,对我国民事诉讼证明标准进行深入研究具有十分重要的意义。本文第二章第一部分首先从证明标准概念的阐述着手,分析证明标准的内涵。证明标准,实质上就是诉讼证明应当达到的一个状态,是指当事人对待证事实进行证明所应达到的程度或要求。阐述证明标准与证明责任、证明要求这三个易混淆概念的关系,理清证明标准的外延。第二部分分析证明标准的特征,即法定性、稳定性、内容的客观性以及适用的主观性。第三部分阐述证明标准所承担的法律功能以及证明标准的确立对于研究民事诉讼理论和指导民事诉讼实务所具有的重大意义,这些均是为本文系统地研究证明标准问题做准备。第三章从比较法的角度对国外民事诉讼证明标准进行考察。通过了解两***系民事诉讼证明标准,即“优势证据”标准与“高度盖然性”标准,进而对两***系的民事诉讼证明标准进行比较,这些国外关于民事诉讼证明标准的经验和成功做法,使本文论述我国民事诉讼证明标准有了参考模式。本文的核心部分是第四章和第五章。这两章首先说明我国传统民事诉讼证明标准,并提出学者们的质疑及学者们提出的相关建议。其次,针对我国民事诉讼证明标准之初步改革,阐明自己的质疑。再次,对于构建我国民事诉讼证明标准提出自己的一些看法。从建立健全我国民事诉讼证明标准应考虑的因素,至我国采用“优势证据”证明标准的理由与层次,最后落实到相关配套规则的完善与建立。关键词;证明标准;证明责任;优势证据证明标准 Abstract Abstract ‘PImestandard hasdetermined not only our criticism on amatter but also oar understanding ofit,even itsexistence,in other words,the standard makes us have reasoR tobesare ofthepresent ofthe matter'’.Intheevidencelaw,the standard of proof isthe referee’syardstick,and cole andsoul inthe law Bi YuOian ofoar country haspointed out:”Formany years,the standard ofproof is a hardandpuzzled work forthe case factto beassertedin thecivil actionofChina all thetime,even tothisday,this problem has notbeensolved intheoretical researchand trialpractice ultimately,thus leavesan obvious ing inthe lawsuit circlesof oarcountry.”So,it is ameaningful work to further study inthestandard ofproof of the civilactionin ourcountry.
