摘要现代社会中,随着社会发展、科学知识的普及和民众权利意识的提高,传统医疗中的父权模式受到了前所未有的挑战,医方与患方之间的关系也变得愈加紧张,医疗纠纷成为社会倍受关注的焦点。本文拟通过对医疗事故的概念、要件、认定标准、举证、鉴定以及赔偿等若干理论问题的研究,借鉴国外立法经验、结合实际案例,对我国医疗事故立法提出完善的建议。本文分为三个部分,第一部分首先阐述了医疗事故的概念和医疗事故责任的性质,然后对医疗事故的构成要件进行细致的分析。根据我国医学界和法学界的普遍理解,医疗事故是指医疗机构及其医务人员在医疗活动中违反诊疗护理规范、常规,过失造成患者人身损害的事故。其构成要件有四:首先医方实旌了医疗行为:其次医方在医疗行为中存在过失,过失的判断标准为医疗水准原则:第三要有损害事实的发生;最后医方的过失行为与损害结果之间要有因果关系。第二部分为“医疗事故责任之认定”。主要论述医疗事故的举证责任和医疗事故鉴定。我国2002年国务院《医疗事故处理条例》和最高人民法院《关于民事诉讼证据若干规定的司法解释》对我国医疗事故举证责任分配和医疗事故鉴定制度作出了很大改进,但随之又引发了更大的问题。本部分通过对西方国家相关规定的介绍,分析目前我国立法中存在的不足及成因,提出改进的构思。第三部分为“医疗事故的赔偿责任”。论述医疗损害赔偿关系的当事人、医师的专家责任和医疗机构的替代责任、医疗损害赔偿范围一一包括直接损害赔偿与间接损害赔偿,以及赔偿计算中的损益相抵和过失相抵、过失责任程度和疾病参与度、医疗损害赔偿中的风险分散制度以及对我国相关立法的设想。关键词:医疗事故、责任认定、赔偿责任 Abstract Witll thedevelopment ofthesociety,the popularization ofthescience knowledge. and theincrease ofpeople’S awareness mode intraditional medicine hasencountered theunprecedented relationship between tlle hospital and thepatients ordingly es changes make the medical disputes one ofthefocuses ofthe ofmedical malpractice handling,which was issuedin2002,has provided certaininstructions for medical malpractice cases,yet thereiSroom on thedefinition. constitutive requirements,identification pensation ofthe medical malpractice thepresent paper is toput forward some suggestions forthelegislationsconcerning medical malpractice inChina withthehelp oftheexperiences ofothercountries and some cases雒well.
