摘要
醉酒犯罪问题一直是一个严重的社会问题,醉酒犯罪在近年一直呈上升趋
势,同时给社会造成的危害和损失日益严重。为此,如何正确处理醉酒犯罪成为
一个迫切需要解决的问题。对于醉酒犯罪的处罚依据,可谓众说纷纭,对理论依
据的争论造成了各国刑法处罚醉酒犯罪的规定的不同。我国刑法处罚醉酒犯罪的
规定过于简单概括,并且没有相关的司法解释对该条文进行说明,由此也导致了
实践中应用刑法处罚醉酒犯罪时的困扰。因此,研究处罚醉酒犯罪的理论依据,
并对刑法关于醉酒犯罪的立法完善提出自己的建议,具有一定的现实意义。本文
正文分为四部分:
第一章:醉酒犯罪概述。介绍醉酒犯罪的含义、类型以及历史渊源;
第二章:醉酒犯罪刑事责任的理论依据及评价。分析中外关于醉酒犯罪承担
刑事责任的各种理论学说的利弊,提出自己的观点:主观方面延续;
第三章:醉酒犯罪的类型化分析。运用主观方面延续观点,分析各种类型的
醉酒犯罪的主观方面以及刑事责任;
第四章:醉酒犯罪的立法建议。分析我国以及世界各国关于醉酒犯罪的立法
模式,提出对我国关于醉酒犯罪处罚问题总则以及分则的立法建议。

Abstract
Drunk crime is always a serious social problem, drunk crime in recent years have
been rising and gave the social harm and loss caused by the increasingly serious.
Therefore, how to correctly handle the drunk crime e a urgent problems to
solve. For the drunk crime punishment based on, it may be said to be retricted
theoretical basis, the debate has all the provisions of the criminal law of punishing
drunk crime is different. Our country criminal law of punishing drunk crime
prescribed too simple generalization, and no relevant judicial explanation to this
provision illustrated, which led to the application practice of criminal law of
punishing drunk crime problems. Therefore, the study of punishing drunk crime is

mendations, has certain practical significance. This text is divided into four
