论片面共犯中文摘要 I 论片面共犯中文提要片面共犯是刑法学界争议较大的一个概念,其争议的焦点在于是否承认片面共犯具有共犯的性质、片面共犯的种类以及片面共犯的刑事责任追究等方面。由于我国现行刑法尚未明确规定片面共犯这一概念,这便为片面共犯理论的学****研究造成了困难。同时,也无法为刑事司法实践中出现的片面共犯定罪处罚提供一致的理论依据, 不利于正确定罪量刑,实现罪责刑相适应。本文从片面共犯的理论渊源谈起,分析、论证了片面共犯的内涵、基本类型及其刑事责任、出路等问题,旨在通过对片面共犯基本理论所进行的系统梳理,能够进一步推动片面共犯理论的发展并在刑事司法实践中广泛应用和充分完善,从而在刑事审判中促进相关案件公正解决的真正实现。关键词:片面共犯共同犯罪刑事责任作者:黄菊指导教师:李晓明英文摘要论片面共犯 II On Unilateral plice Abstract There are many arguments about unilateral plice in the theory of criminal law, the focus of the controversy lies in whether the unilateral plice has the nature of plice or not , the kinds of unilateral plice and the criminal responsibility. The current criminal law of China has not clearly defined the concept of the unilateral plice , so it is difficult to learn, study of the unilateral plice theory. At the same time, it cannot provide a consistent theoretical basis for the convicted and punished of the unilateral plice in the criminal justice practice and is not conducive to correct convicting and sentencing, the realization of criminal responsibility. The dissertation starts from the theoretical origin of the unilateral plice, demonstrates the meaning, way of the unilateral plice, basic types and criminal liability issues, hoping that through the carding of the unilateral plice systematically can further promote the development and widely application of the theory in the criminal justice practice , and achieve fairness and justice in the criminal trial.
