摘要

我国食品安全形势严峻,政府监管效能低下,为了提高政府监管效能,本论
文首先从理论上分析了我国政府监管食品安全的必要性。
其次,介绍我国政府食品安全监管现状以及问题,主要从监管理念,监管体
制,监管方法角度分析,其中,重点分析监管体制与监管方法中存在的问题,监
管体制主要从机构设置、职能配置、权力分配、运行机制这四个方面入手进行研
究,监管方法包括法律法规手段、政策手段、技术手段等三个方面。
最后,探寻我国政府监管低效成因以及对策,我国政府监管效能低下原因主
要在于我国对食品安全监管部门的行政权力特性缺乏充分系统的认识,对其缺少
有效的监督,食品安全监管部门没有建立起有效的监督机制,其中监督机制包括
自律机制和他律机制,尤其是监管部门的自律机制不完善,从而也不能够建立起
完善的行政问责制,绩效考核制等有效的监督制度,当然,自律机制的完善依赖
于他律机制的完善。而他律机制的完善本质上属于我国政治体制改革的内容。
因此,解决我国食品安全问题取决于政府监管效能的提高,而政府监管效能
的提高宏观上依赖于我国政治体制改革的进行,因此,我们对食品安全监管效能
的提高有个理性期待,要站在政治体制改革的高度看问题,它是一个长期而复杂
的过程。

Abstract

There is a severe situation of food security in our country. We also have a low
government effectiveness in our country. In order to strengthen government supervision
efficiency, this paper first analyze of the necessity of government regulation of food
safety in China from a theoretical view.
Secondly, introduce the current situation and problems about government
supervision of food security. It is analysis from supervision concept, supervision
structure, and supervision method, which mainly focusing the exists of problem about
supervision structure and supervision method. We analyze the supervision structure
from four respects: structural establishment, functions configuration, power distribution,
and operational mechanism. Supervision method include three aspects ,such as legal
regulations means, policy means, and technology means.
Finally, exploring the causes and countermeasures of our governmen
