浅谈建筑工程合同管理 存在问题及对策

摘 要： 目前从建筑市场经济活动及交易行为看，工程建设的参与各方缺乏市场经济所必须的法制观念和诚信意识，不正当竞争行为时有发生，承发包双方合同自律行为较差，加之市场机制难以发挥应有的功能，从而加剧了建筑市场经济秩序的混乱。工程建设的复杂性决定施工合同管理的艰巨性，使得建设施工合同管理中存在诸多问题。随着建筑市场的全面开放，建筑企业应尽快树立国际化意识，遵循市场规则和国际惯例，加强建设工程施工合同的规范管理，建立行之有效的合同管理制度。

Abstract: Now from the construction market economic activities and trade behavior, construction of the parties involved a lack of market economy must be legal concept and good faith consciousness, ACTS of unfair competition, self-discipline is poorer, the contracting parties contract combined with the market mechanism is difficult to play their functions, adding to the chaos in the construction market economic order. Construction of the complexity of the decision task of construction contract management, many problems exist in the construction contract management. As the construction market fully open, the construction enterprises should set up the ideas of internationalization as soon as possible, follow the market rules and international practice, strengthen the standard management of the project construction contract, establish effective contract management system.
