不动产预告登记制度的分析研究.pdf

中文摘要中文摘要不动产预告登记制度是民法中关于不动产物权变动的重要制度,它以预防风险为价值取向,旨在保护期待不动产物权变动的权利人基于其不动产物权取得的的债权请求权的利益。它起源于普鲁士,在德国、瑞士、日本等大陆法系国家和我国台湾地区的民法典中均有明确的规定,是不动产物权制度中不可或缺的组成部分。 2007年3月16日第十届全国人民代表大会第五次会议通过了《物权法》,该法在吸收、借鉴国外立法的基础上结合我制度,对该制度的适用范围、效力和消灭作出了规定。笔者从比较法的角度,通过对德制度的比较研究,对预告登记的起源、适用范围、性质和法律效力做了详细分析, 并对我制度内容进行了评析,提出了进一步完善该项制度的一些见解。关键词:预告登记;物权变动;物权;债权黑龙江大学硕士学位论文 Abstract Notice ofreal estate registration system inChina and France on theimportance of changes in realproperty system toriskprevention foritsvalue orientation,looking forwardto realproperty toprotect theright tochange itsreal estateproperty based on claimsmade intheinterests oftheright originated in Prussia inGermany, Switzerland,Japan and China's civil law countries such as Taiwan’S Civil Code provisions ale clear,realproperty system isan integralpart.
