中图分类号旦窆2垒 UDC 343 学校代码!Q53三密级公珏硕士学位论文论我国缓刑的适用条件 OnRequirement ofProbation Application inPenal Code ofPRC 作者姓名: 学科专业: 研究方向: 学院(系、所): 指导教师: 论文答辩日期弛1弓:∑:z6 彭思亮法学刑法学法学院王飞跃答辩委员会主席:鲣中南大学二0一三年五月论我国缓刑的适用条件摘要:《中华人民共和国刑法修正案(八)》对于缓刑的适用条件进行了较大幅度的修改,具有重要的意义。缓刑适用条件应当分为形式条件、实质条件和排除条件三大类,其中形式条件又包括罪种条件、刑种条件、刑期条件。我国刑法没有对缓刑适用的罪种作出限制,即没有规定适用缓刑的罪种条件,另外,我国也没有必要对缓刑适用的罪种条件进行规定;在实质条件中,犯罪情节较轻的认定要围绕犯罪主体、犯罪主观方面、犯罪客体和犯罪客观方面来进行;没有再犯罪的危险的认定也需要将定性评估方式和定量评估方式结合;有悔罪表现主要包括自首、立功、坦白交待罪行、赔礼道歉等几个方面;关于宣告缓刑对所居住社区没有重大不良影响的认定,应当从社区居民、社区本身、犯罪分子本身情况,犯罪分子的外在情况四个方面入手来进行。《刑法修正案(八)》规定了对于特殊群体在一定情形下应当被适用缓刑;关于未满十八周岁、已满七十五周岁,应当以审判时作为年龄的起算点;怀孕的妇女也应理解为审判的时候怀孕的妇女。数罪并罚情形下的缓刑适用,应当以可以适用缓刑为宜,但考虑到犯有数罪的犯罪分子其人身危险性比较高,在具体的实务操作过程中,对符合条件的数罪犯,应当严格掌握其缓刑适用,以体现刑法的严谨性与公平性。关键词:缓刑;适用条件;理解;认定分类号:D924 On Requirement ofProbation Application inPenal Code ofPRC Abstract:The applicable conditionsofprobation occupy averyimportant position intheprobation system,more oftheoreticalstudy andpractical opermion oftheprobation also alotofcontroversy point.
