　　内容提要: 文章认为，衡平原则在法律适用中的作用已为越来越多的法官所认同，然而将衡平原则引入诉讼法、特别是证据法中，让法官在分配举证责任、取舍证据时也适用衡平原则，在国内法学界还是一个新课题。文章就衡平原则在证明责任中的运作与意义作浅显的分析，希望能对准备制订中的《民事证据法》有些微帮助，对我国的法官审理案件有所启示。
