上海交通大学硕士学位论文论战时缓刑制度姓名:王世萍申请学位级别:硕士专业:法律指导教师:金泽刚 20100608 论战时缓刑制度摘要缓刑是当代刑罚制度的宠儿, 而战时缓刑制度是在缓刑制度的基础上发展而来的一种特殊缓刑制度, 是对缓刑制度的重要补充,它与一般缓刑制度共同构成了我国刑法中缓刑制度的整体。但由于在司法实践中适用战时缓刑的机会较少,致使有的同志在认识、理解和适用战时缓刑制度上存在一些误区与偏差。近年国际国内形势并不太平, 战乱和冲突时有发生,自然灾害频发,军队尤其是武警部队正发挥着越来越重要的作用,如何激励军人发挥战斗力,更大限度的保障国家主权利益和人民生命财产安全,应是社会各界,包括法学界亟需考虑的问题。本文从我国战时缓刑制度建立的背景及意义出发,将战时缓刑制度与一般缓刑制度的关系进行了比对分析, 在明确了战时缓刑制度中关于“战时”、“军人”和“立功”等重要概念的基础上,对战时缓刑的执行、战时缓刑中军事指挥官的介入权等问题进行了较深入的研究,并对战时缓刑制度的进一步完善提出了几点立法建议,希望战时缓刑制度能早日在司法实践中真正发挥出更好、更大的作用。关键词: 战时,军人,立功,缓刑,执行 WARTIME PROBATION SYSTEM ABSTRACT Probation is the darling of the c ontemporary penal system, while the wartime probation system is the basi s of the probation system, developed from a special probation system and probation system is an important complement, it generally constitute the Probation Probation Criminal Law system as a whole.
