试论罪刑均衡的功能性蕴涵
「内容提要」“法律是功能性的”，罪刑均衡作为刑法的一项基本原则，也必然是功能性的。构建法治 秩序，特别是刑事法治秩序，必须强调罪刑均衡的功能性蕴涵。罪刑均衡原则对社会的影响 程度，在一定程度上取决于罪刑均衡功能的状态和结果。不注重功能的罪刑均衡原则难以实 现真正的刑事法治。研究罪刑均衡的功能性蕴涵，正是着眼于现代刑事法治的建设，其归宿 点也将最终落于法治秩序的实现上。作者认为，罪刑均衡原则的功能性蕴涵主要体现在三个 方面：一、情感抚恤功能，指的是通过对一定的犯罪处以相应的刑罚（等害交换），从而使被 害人及社会善良的人的“一种天生的追求对等性（Recigocity）的本能”得到满足；二、保护 社会功能，指的是适用罪刑均衡原则对社会所产生的作用（预防犯罪），从而达到防卫社会； 三、人权保障功能，指的是通过罪刑均衡原则的建立，制约国家刑罚权（制约强权），防止因 刑罚权的滥用而侵犯公
