1 浅析影视作品中的著作权保护问题摘要随着因特网的普及和网络技术的发展,影视作品的涵盖范围也越来越广,由此在司法实践中引发的矛盾纠纷也越来越多,不论是 2013 年备受关注的《人再囧途之泰囧》侵权案还是 2014 年备受争议的于正侵权案,都因立法方面的不完善和规范的缺失而存在很多疑难杂点。中国自 1990 年颁布《中华人民共和国著作权法》以来,经 2001 年第一次修正、 2010 年第二次修正以及 2012 年3月、 2012 年7月和 2014 年6月三次就三修草案公开征求意见,其在影视作品著作权保护方面虽仍存在诸多漏洞,但也在逐渐走向趋于完善的道路。本文以影视作品的著作权保护为研究对象,除前言与结论外,另分五个部分进行陈述。首先从影视作品的概念入手,介绍了其含义以及相关概念、意义等,然后通过我国著作权归属问题以及影视作品著作权保护现状,指出我国在影视作品立法、执法等方面的不足,进而提出相关改进建议。关键字: 影视作品;著作权归属;侵权判定;侵权责任 A RESEARCH ON THE COPYRIGHT PROBLEMS OF FILM AND TELEVISION WORKS ABSTRACT With the populari zation of the and the development work techn ique , the range of film and television works also turns to be wilder , which cause an increasing number of infringement disputes in judicatory practice . There are some questionable points both in the most attractive infringement dispute of" Lost In Thailand " in 2013 and the most controversia l infringement case between Yu Zheng and Qiong Yao in 2014 because of the ambiguous of Copyright Law. Since China first promulgated the "COPYRIGHT LAW OF THE PEOPLE'S REPUBLIC OF CHINA ” in 1990, after the first revision in 2001, the second correction in 2010 and three times ’ consultation for public opinion in March 2012, July 2012 and June 2012 respectively , the copyright protection of film and television works is gradually perfect ed regardless of some legal loophole esides preface and conclusion , the other parts of the paper, selecting the copyright protection of film and television works as the research object, are divided into five different sections. 2 The f irst section starts with the concept of the film and television works, introduc ing the meaning , the related concept , and the significance. The second section states the ownership of the film and television copyright in china. The third section illustrates how judicial office and the administrative department of copyright law protect the copyright of film works. The fourth and fifth e up with some problems and suggestions.
