论我国民法典总则的制定

　　内容提要: 本文通过考察大陆法系国家在制定民法典时对总则的取舍及其原因，结合当代民法典的发展趋势，分析了未来我国民法典中设立民法总则的有关问题。文章认为，我国有必要制定一部自己的民法典，在民法典中应当规定总则。民法总则的内容应来自对现有民法通则的增删损益。文章提出了自己对我国未来民法总则体例的设计。
　　法学界关于制定我国民法典的讨论由来已久。讨论的内容涉及制定民法典之必要性、可能性、民法典的制定方法、民法典的体系结构等方方面面的事项。目前，关于民法典制定的讨论更多地集中在实际问题上：我们应当如何制定民法典，制定一部什么样的民法典?对于如何制定，目前学者基本上赞同先分步制定各个分则，然后再编纂成民法典的方式。关于体例，学者们主X以德国民
