摘要：善意取得制度是非依法律行为引起物权变动的重要类型。自《物权法》明确规定善意取得制度(第106条、第107条)以来，实践中相关案例频频出现，不乏一些复杂疑难案例。针对实践中一起冒名出售房屋案，《判解研究》(2009年第2辑)特邀多位著名法学家和青年学者，就《物权法》视野下不动产的善意取得若干问题进行深入讨论，涉及到善意取得的诸多具体理论和实践问题。现将这些讨论陆续登出，以供参考和交流。本篇为杨立新教授的《论不动产善意取得及适用条件》。
