河北大学硕士学位论文劳动争议纠纷处理制度完善姓名:杨超申请学位级别:硕士专业:法律硕士(法学) 指导教师:刘志刚 2011-06 摘要 I 摘要 自八十年代末我国恢复劳动争议纠纷处理制度到现在已经二十余年的时间了。这期间随着我国社会主义市场经济的不断发展以及经济体制改革的渐次深入,国有企业体制的改革以及新型企业制度的建立成形,我国劳动关系也处在一个微妙的转型期,在转型过程中各种各样的劳动争议纠纷不断涌现,并呈现出新的特点。在计划经济体制下建立起来的“一调,一裁,二审”制度已经明显不能适应现实的需求,改革的紧迫性已经呈箭在弦上之势,本文旨在通过自身的努力,整合现行制度、创新体制机制,为我国劳动争议纠纷解决机制的最终完善以及形成进绵薄之力。本文可以分成以下几部分: 第一部分,首先就是对于我国现行的劳动争议纠纷解决机制的运行进行概述。第二部分,是对于我国现行主要劳动争议纠纷解决机制弊端的评析。第三部分,主要是介绍国内比较流行的解决劳动争议的学术界观点,进行评述,分析优劣,希望可以取其精华去其糟粕为我所用。第四部分,是本文的核心内容,主要就是对于笔者自己的希望构建的解决劳动争议纠纷制度的论述。关键词: 劳动争议处理机制内部协商社会调解行政仲裁审判 Abstract II Abstract Abstract: It is more than twenty years si nce the resumption of labor disputes handling system in China late een eighties. Du ring this, in China the establishment of the State-pany reforms and the modem enterprises system took shape under the background of the ceaseless development on social ist market economy and the in-depth step on reform of the economic system. Meanwh ile, the labor relation was in a subtle transformation period and in this process various labor disputes are ceaseless emerge in large numbers presenting some new ch aracteristics. The system which was used at present obviously could not adapt the need of the present practice. The urgency of reform on it presents like an arrow on the bow string. This thesis aims to un ify current system and innovate institutional and mechanisms through the aut hor’s own effort in order to promote the establishment and fully consummation of the Labor disputes in th e dispute settlement mechanism. This paper was divided into three parts: The first part, the author makes m ents on the present labor disputes in the dispute settlement mechanism to seek the def ect and shortage, highli ghting the necessity and urgency of reform. The second part is for the analysis on the malpractice of the labor dispute settlement mechanism settlement which was currently used in our country. The third part, mainly introduce and recital the domestic pres ent more popular view
