　　一、国际商事仲裁裁决的撤销程序
　　(一)撤销裁决程序的当事人
　　
　　撤销程序的申请人是指有权提出仲裁裁决撤销程序申请的当事人。由于当事人与裁决的结果有直接的利害关系，他最关心裁决的结果，因而也只有当事人最了解自己的合法权益是否受到了侵害，所以法律规定，提出申请撤销裁决从而启动撤销程序的主体必须是当事人。
　　这里的当事人应包括原仲裁的当事人双方，即原仲裁的申请人和被申请人。因为申请撤销仲裁裁决是法律赋予仲裁双方当事人的一项司法救济权利。原则上，申请撤销裁决的当事人应同是仲裁协议、仲裁案件和仲裁程序的当事人，否则任何一方可抗辩双方之间不存在仲裁协议，未发生争议，其未参与仲裁程序等，因而对方无权提出撤销裁决申请。通常的观点也认为，仲裁协议的当事人应与仲裁案件的当事人同一，但这显然不是绝对的，而存在例外情形。
