侦查制度的完善对人权保障的作用
摘要: 侦查作为侦查机关代表国家针对个人进行的追诉活动,几乎无时不面临限制或者剥夺公民个人自由和权益的问题,也存在着侦查机关和侦查人员滥用权力的危险。如何构建完全、合理的侦查制度,这也是我国正积极探索的一个重要法学课题,我国现有的侦查制度在打击和惩罚犯罪方面发挥了巨大作用,但也存在一些弊端。在我国尊重和保障人权是宪法的一项基本原则,也是司法改革的价值目标。一直以来,我国侦查制度的改革与完善都是以尊重和保障人权作为其核心的内容。随着司法改革进程的不断深入、新刑事诉讼法的实施,侦查制度尊重和保障人权的价值内涵得以不断延伸。我国侦查制度的不断改革与完善可以更好地适应我国尊重和保障人权的需要和促进我国社会主义法治国家的建设。
本文从我国现行侦查制度以及人权保障的新近发展方面对我国在建设社会主义法治国家中侦查制度的改革与完善,结合国外的侦查制度与人权保障方面的制度要求,从中与我国现行的侦查制度与人权保障方面问题的比较与分析,从而达到我国的侦查制度与人权保障问题的深化改革与完善的目的,不断推进我国社会主义法制化建设。

Abstract: the investigation of countries as a representative of the an for individuals to prosecution activity, almost all face restriction or deprivation of citizens' personal freedom and rights and interests of the problem, there are in danger of ans and their staff abuse of to build plete and rational system of investigation, this is also our country is an important subject of law, actively explore the existing investigation system in China has played an important role in the fight against and punish crime, but there are also some and safeguard human rights in our country is a basic principle of the constitution, it is the value goal of judicial a long time, our investigation system reform and perfect are based on respect and safeguard human rights as its core the deepening of the judicial reform process, the implementation of the new criminal procedure law, the value of the detection system to respect and safeguard human rights connotation extends reform and perfect detection system in China can better meet the needs of the respect and safeguard human rights in our country and promote the construction of a socialist country under the rule of law in our country.
