in China before 2009 can not catch up with the develop ing of Cybercrime. The amendment 7 th of China Penal Code took
effect on March 1 th, 2009 adds three new cybercrimes: illegal obtaining computer data, illegal controlling computer sys
tem and abusing of device, which help s to perfect the crim inal legislation on Cybercrime, but the new articles related to
Cybercrime still have some shortcom ings. Convention on Cybercrime of Council of Europe became effective on July 1 th,
2004 can benefit for perfection of China crim inal law on Cybercrime, so comparative research between them is done and
concrete suggestions are given in this thesis.
