【内容提要】听证制度是现代行政程序法的核心制度,我国行政处分法第一次以法律形式确立了听证制度,行政许可法在听证程序上又有了进一步的完善,听证笔录在行政决定中的法律效力是听证制度的关键所在。本文通过阐述我国目前有关听证笔录的法律规定,对听证笔录的法律价值进行了简要思考并提出了有关措施。

听证一般是指在国家机关作出行政决定之前,给予利害关系人提供发表意见的时机、提出证据对特定事项进行质证、辩驳的程序。听证程序是行政程序法的核心内容之一,其目的在于查清事实真相,允许当事人与案件调查人员当面质证和辩驳,赋予当事人发表意见的权利。听证笔录是行政机关对听证过程所作的书面记录,该记录对行政决定的作出具有十分重要的作用。我国近年借鉴西方国家法律成果,初步形成了行政听证程序制度,在行政处分、行政许可方面对听证程序作出了具体规定。
一、我国关于听证笔录的有关法律规定

“听证〞一词来源于英美法。英国普通法中的来源“自然公正原那么〞是听证程序最早的法律根底,较早在法律上确立行政听证制度的是美国联邦行政程序法。这个法律的规定,改变了传统行政法上的“行政效率优先〞的原那么,而代之以保障公民根本权利和控制行政权的法制原那么。当事人有权获得为自己利益进行辩护的权利,即听证的权利。我国1996年公布的?中华人民共和国行政处分法?首次正式引入行政听证程序。行政处分法第42条规定:“行政机关做出责令停产停业、撤消许可证或执照,数额较大的罚款等决定之前,应当告知当事人有要求举行听证的权利;当事人要求举行听证的,行政机关应组织听证。〞、“听证应当制作笔录,笔录应当交当事人审核无误后签字或者盖章〞。第43条规定:“听证结束后,行政机关依照本法第三十八条的规定,作出决定。〞第38条规定:调查终结,行政机关负责人应当对调查结果进行审查,根据不同情况,分别作出决定。2000年通过的?中华人民共和国立法法?规定,在行政法的起草过程中为广泛听取意见可以采取听证会的形式。2023年通过的?中华人民共和国行政许可法?第46条和第47条分别规定了行政机关依职权举行听证及依相对人、利害关系人的申请举行听证这两种情形。第48条规定:“听证应当制作笔录,听证笔录应当交听证参加人确认无误后签字或者盖章。〞“行政机关应当根据听证笔录,作出行政许可决定。〞2023年通过的?中华人民共和国行政复议法实施条例?第33条规定:“行政复议机构认为必要时,可以实地调查核实证据;对重大、复杂的案件,申请人提出要求或者行政复议机构认为必要时,可以采取听证的方式审理。〞除上述法律、行政法规外,其他地方性法规及规章等也在行政处分、行政许可、行政立法〔决策〕和行政复议等方面规定了行政听证制度及有关程序,内容大同小异。

国家各部委和地方政府相继出台的有关法规、规章中对行政听证笔录也作出了各种规定,如?水行政许可听证规定?第15条中要求:“听证应当制作笔录。听证笔录应当载明以下事项:〔一〕听证主持人和其他听证工作人员的姓名、职务;〔二〕听证参加人的姓名〔名称〕、地址等根本情况;〔三〕听证的事由、时间和地点;〔四〕听证参加人提出的意见、理由和证据;〔五〕听证参加人的申辩、质证和陈述情况;〔六〕听证延期、中止的说明;〔七〕听证主持人对听证过程中有关事项的处理情况;〔八〕其他需要载明的事项。〞“听证结束前,应当向听证参加人宣读听证笔录或者交其阅读,听证参加人确认无误后签字或者盖章。听证参加人认为笔录有错误或者疏漏的,有权要求改正;听证参加人拒绝签名或者盖章的,应当在听证笔录中载明情况。〞?民用航空行政许可工作规那么?第43条规定:“记录员应当将举行听证的情况记入听证笔录。听证笔录应当载明以下内容:〔一〕申请听证事由;〔二〕举行听证的时间、地点;〔三〕行政机关听证人员的姓名、职务;〔四〕听证参加人的姓名或者名称、地址;〔五〕行政机关许可审查人员提出审查意见的证据、理由;〔六〕听证申请人、利害关系人或者其代理人的陈述;〔七〕审查人员、申请人、利害关系人或者其代理人质证、辩论的内容;〔八〕其他事项。〞?中华人民共和国海关行政处分听证方法?第29条规定:“听证应当制作笔录。听证笔录应当列明以下事项:〔一〕案由;〔二〕听证参加人及其他人员的姓名或者名称;〔三〕听证主持人、听证员、记录员的姓名;〔四〕举行听证的时间、地点和方式;〔五〕案件调查人员提出的本案的事实、证据和拟作出的行政处分决定及其依据;〔六〕陈述、申辩和质证的内容;〔七〕证人证言;〔八〕按规定应当列明的其他事项。〞

“听证笔录应当由听证参加人及其他人员确认无误后逐页进行签字或者盖章。对记录内容有异议的可以当场更正后签字或者盖章确认。听证参加人及其他人员拒绝签字或者盖章的,由记录员在听证笔录上注明。〞从上述有关规定可以看出,各部门对听证笔录的根本内容比拟一致,如听证参加人根本情况,听证事由,听证时间、地点和方式,听证参加人的意见,质证过程等。

听证笔录涉及当事人和行政机关双方的意见和对证据确实认与否认,行政机关能否把听政笔录作为证据使用呢?听证笔录对行政机关作出的决定有无约束力?相当多国家的行政程序法对此作出了规定,主要有两种态度:一是美国行政程序法坚持的案卷排他性原那么。美国?联邦行政程序法?第556条第5款规定:“证言的记录、物证连同裁决程序中提出的全部文书和申请书,构成按照本编第557条规定作出裁决的唯一案卷。〞可见美国实行的是绝对案卷排除规那么。既行政行为只能以案卷作为根据,以经过听证记录在卷的证据为事实根据,不能在案卷之外,以当事人未知悉的和未质证的证据为根据,行政认知除外,行政机关的决定必须根据听证会的案卷作出,不能在案卷之外,以行政相对人不知道或没有在听证会上论证的事实作为根据,否那么行政决定无效;二是日本、德国、韩国、瑞士等国家规定的听证记录对行政决定的作出有一定的约束力,但行政决定不是必须以听证记录作为根据。行政机关在作出决定时,应斟酌听证记录,然后作出行政决定,如日本行政程序法第26条规定,“行政机关为不利益处分决定时,应充分斟酌笔录内容及报告书中主持人意见。〞“个人、组织有权陈述意见,执法者必须认真听取,记录在卷,并作为处分决定的重要根据。〞“听证笔录是行政机关作出行政处分决定的根据之一;也是当事人不服行政处分决定提起行政诉讼时,行政机关向人民法院提供的证据一。〞。
我国目前虽然对听证笔录的内容及补正等方面作出了有关规定,但对听证笔录的效力和法律适用并没有作出明确的规定,各地各部门的听证实施方法对此作了一定的补充。如?上海市行政处分听证程序施行规定?第26条规定:

“听证笔录应当作为行政机关做出行政处分决定的依据〞。?劳动行政处分听正程序规定?第16条规定:“劳动行政部门不得以未经听证认定的证据作为行政处分的依据〞。?政府价格决策听证暂行方法?第24条规定,“应充分考虑听证会提出的意见〞,但未规定听证记录和听证纪要的法律效力。
行政决定的作出应当充分考虑和重视当事人在听证程序提出的意见及证据材料,但听证笔录及相关材料是否构成决定的唯一依据并没有定论,这样实际上就难免使得听证活动的作用大打折扣,造成听证结论的有效影响小。也就是说,在现有规定的情况下,行政决定人仍可凭在听证案卷记录之外的当事人所未知悉和未申辩的事实作为依据去作出决定,这实际上是与听证程序所要求的对当事人所举证、陈述和辩论所认定的事实予以充分考虑,和行政机关不得以当事人不知晓和未经辩论的事实为依据作出裁决的本质特征相背离的,其后果将使听证结论的有效影响小,难免成为某种形式的走过场而已。在目前实践中,很多听证会结束后,行政机关并没有根据听证会上当事人提交的证据作决定,出现了“听而不证〞现象。
三、发挥行政听证笔录的法律价值应采取的措施
〔一〕建立健全听证笔录制度。我国行政处分法和行政许可法没有对笔录当中应当涉及哪些事项进行明确规定,这样宽泛的自由度无疑会使听证程序形同虚设。各地各部门对此作了补充规定,但难免出现不一致。?行政处分法?中对行政处分决定书的内容要件做了明确的规定,我国有关法律法规也应对听证笔录的内容进行统一,为基于听证程序作出的行政决定奠定根底。
