STUDENTCODEOFCONDUCT
Purpose
TheStudentCodeofConductisthedistrict’sresponsetotherequirementsofChapter37oftheTexasEducationCode.
TheCodeprovidesmethodsandoptionsformanagingstudentsintheclassroomandonschoolgrounds,discipliningstudents,andpreventingandinterveninginstudentdisciplineproblems.
Thelawrequiresthedistricttodefinemisconductthatmay—ormust—resultinarangeofspecificdisciplinaryconsequencesincludingremovalfromaregularclassroomorcampus,out-of-schoolsuspension,placementinadisciplinaryalternativeeducationprogram(DAEP),orexpulsionfromschool.
ThisStudentCodeofConducthasbeenadoptedbythePineTreeBoardofTrusteesanddevelopedwiththeadviceofthedistrict-,consequencesofmisconduct,andproceduresforadministeringdiscipline.
Inaccordancewithstatelaw,,theCodewillbepostedonthedistrict’,placedinaDAEP,orexpelled.
BecausetheStudentCodeofConductisadoptedbythedistrict’sboardoftrustees,ithastheforceofpolicy;therefore,incaseofconflictbetweentheCodeandthestudenthandbook,theCodewillprevail.
PleaseNote:Thedisciplineofstudentswithdisabilitieswhoareeligibleforservicesunderfederallaw(IndividualswithDisabilitiesEducationActandSection504oftheRehabilitationActof1973)issubjecttotheprovisionsofthoselaws.
ParticipatinginGraduationActivities
Thedistricthastherighttolimitastudent'sparticipationingraduationactivitiesforviolatingthedistrict',asestablishedbydistrictpolicyandprocedures.
,inordertobeconsideredasaneligiblestudenttogivetheopeningorclosingremarks,astudentshallnothaveengagedinanymisconductinviolationofthedistrict'sCoderesultinginanout-of-schoolsuspensionremovaltoaDAEP,orexpulsionduringthesemesterimmediatelyprecedinggraduation.

SchoolDistrictAuthorityandJurisdiction
Schoolrulesandtheauthorityofthedistricttoadministerdisciplineapplywhenevertheinterestofthedistrictisinvolved,onoroffschoolgrounds,inconjunctionwithorindependentofclassesandschool-sponsoredactivities.
Thedistricthasdisciplinaryauthorityoverastudent:
Duringtheregularschooldayandwhilethestudentisgoingtoandfromschoolondistricttransportation;
Duringlunchperiodsinwhichastudentisallowedtoleavecampus;
Whilethestudentisinattendanceatanyschool-relatedactivity,regardlessoftimeorlocation;
Foranyschool-relatedmisconduct,regardlessoftimeorlocation;
Whenretaliationagainstaschoolemployeeorvolunteeroccursoristhreatened,regardlessoftimeorlocation;
Whencriminalmischiefiscommittedonoroffschoolpropertyorataschool-relatedevent;
Forcertainoffensescommittedwithin300feetofschoolpropertyasmeasuredfromanypointontheschool’srealpropertyboundaryline;
Forcertainoffensescommittedwhileonschoolpropertyorwhileattendingaschool-sponsoredorschool-relatedactivityofanotherdistrictinTexas;
Whenthestudentcommitsafelony,;and
Whenthestudentisrequiredtoregisterasasexoffender.
Thedistricthastherighttosearchavehicledriventoschoolbyastudentandparkedonschoolpropertywheneverthereisreasonablecausetobelieveitcontainsarticlesormaterialsprohibitedbythedistrict.
Thedistricthastherighttosearchastudent’slockerordeskwhenthereisreasonablecausetobelieveitcontainsarticlesormaterialsprohibitedbythedistrict.
ReportingCrimes
Schooladministratorswillreportcrimesasrequiredbylawandwillcalllocallawenforcementwhenanadministratorsuspectsthatacrimehasbeencommittedoncampus.
RevokingTransfers
Thedistricthastherighttorevokethetransferofanonresidentstudentforviolatingthedistrict’sCode.(SeeBoardPolicyFDA(LOCAL).
StandardsforStudentConduct
Eachstudentisexpectedto:
Demonstratecourtesy,evenwhenothersdonot.
Behaveinaresponsiblemanner,alwaysexercisingself-discipline.
Attendallclasses,regularlyandontime.
Prepareforeachclass;takeappropriatematerialsandassignmentstoclass.
Meetdistrictandcampusstandardsofgroominganddress.
Obeyallcampusandclassroomrules.
Respecttherightsandprivilegesofstudents,teachers,andotherdistrictstaffandvolunteers.
Respectthepropertyofothers,includingdistrictpropertyandfacilities.
Cooperatewithandassisttheschoolstaffinmaintainingsafety,order,anddiscipline.
AdheretotherequirementsoftheStudentCodeofConduct.
GeneralConductViolations
Thecategoriesofconductbelowareprohibitedatschoolandallschool-relatedactivities,-of-SchoolSuspension,DAEPPlacement,Placementand/orExpulsionforCertainSeriousOffenses,andExpulsion,,however,maybeseriousenoughtoresultinRemovalfromtheRegularEducationalSettingasdetailedinthatsection.
Studentsshallnot:
DisregardforAuthority
Failtocomplywithdirectivesgivenbyschoolpersonnel(insubordination).
Leaveschoolgroundsorschool-sponsoredeventswithoutpermission.
Disobeyrulesforconductonschoolbuses.
Refusetoacceptdisciplinemanagementtechniquesassignedbyateacherorprincipal.
MistreatmentofOthers
Useprofanityorvulgarlanguageormakeobscenegestures.
Fightorscuffle.(ForassaultseeDAEPPlacementandExpulsion)
Threatenadistrictstudent,employee,orvolunteer,includingoffschoolpropertyiftheconductcausesasubstantialdisruptiontotheeducationalenvironment.
Engageinbullying,harassment,ormakinghitlists.(Seeglossaryforallthreeterms)
Engageinconductthatconstitutessexualharassmentorsexualabuse,whetherbyword,gesture,oranyotherconduct,directedtowardanotherperson,includingadistrictstudent,employee,orvolunteer.
Engageinconductthatconstitutesdatingviolence,includingtheintentionaluseofphysical,sexual,verbal,oremotionalabusetoharm,threaten,intimidate,orcontrolanotherpersonwithwhomthestudenthasorhashadadatingrelationship.
Engageininappropriateorindecentexposureofprivatebodyparts.

Causeanindividualtoactthroughtheuseoforthreatofforce(coercion).
Commitextortionorblackmail(obtainingmoneyoranobjectofvaluefromanunwillingperson).
Engageininappropriateverbal,physical,orsexualconductdirectedtowardanotherperson,includingadistrictstudent,employee,orvolunteer.
Recordthevoiceorimageofanotherwithoutthepriorconsentoftheindividualsbeingrecordedorinanywaythatdisruptstheeducationalenvironmentorinvadestheprivacyofothers.
Studentsshallnot:
PropertyOffenses
Damageorvandalizepropertyownedbyothers.(ForfelonycriminalmischiefseeDAEPPlacementorExpulsion)
Defaceordamageschoolproperty—includingtextbooks,lockers,furniture,andotherequipment—withgraffitiorbyothermeans.
Stealfromstudents,staff,ortheschool.
CommitorassistinarobberyortheftevenifitdoesnotconstituteafelonyaccordingtotheTexasPenalCode.(ForfelonyrobberyandtheftseeDAEPPlacementandExpulsion)
PossessionofProhibitedItems
Studentsshallnotpossessoruse:
fireworksofanykind,smokeorstinkbombs,oranyotherpyrotechnicdevice;
arazor,boxcutter,chain,oranyotherobjectusedinawaythatthreatensorinflictsbodilyinjurytoanotherperson;
a“look-alike〞weapon;
anairgunorBBgun;
ammunition;
astungun;
apocketknifeoranyothersmallknife;
maceorpepperspray;
pornographicmaterial;
tobaccoproducts;electroniccigarettesoranyotherelectronicvaporizingdevice,PolicyGKA(LOCAL).
matchesoralighter;
alaserpointerforotherthananapproveduse;or
anyarticlesnotgenerallyconsideredtobeweapons,includingschoolsupplies,whentheprincipalordesigneedeterminesthatadangerexists.(ForweaponsandfirearmsseeDAEPPlacementandExpulsion)
Studentsshallnot:
PossessionofTelecommunicationsDevices
Useatelecommunicationdevice,includingacellulartelephone,orotherelectronicdeviceinviolationofdistrictandcampusrules.(Ifcellulartelephoneorothertelecommunicationsdeviceisseenorheardoutsideofthecampusordistrictrules,itwillbeconfiscatedandsubjecttoa$15fineforitsreturnaswellastheholderofsuchdevicebeingsubjecttodisciplinaryaction.)
Studentsshallnot:
Illegal,Prescription,andOver-the-CounterDrugs
Possessorsellseedsorpiecesofmarijuanainlessthanausableamount.(Forillegaldrugs,alcohol,andinhalantsseeDAEPPlacementandExpulsion)
Possess,use,give,orsellparaphernaliarelatedtoanyprohibitedsubstance.(Seeglossaryfor“paraphernalia〞)
Possessorselllook-alikedrugsorattempttopassitemsoffasdrugsorcontraband.
Abusethestudent’sownprescriptiondrug,giveaprescriptiondrugtoanotherstudent,orpossessorbeundertheinfluenceofanotherperson’sprescriptiondrugonschoolpropertyorataschool-relatedevent.(Seeglossaryfor“abuse〞)
Abuseover-the-counterdrugs.(Seeglossaryfor“abuse〞)
Beundertheinfluenceofprescriptionorover-the-counterdrugsthatcauseimpairmentofthephysicalormentalfaculties.(Seeglossaryfor“undertheinfluence〞)
Haveortakeprescriptiondrugsorover-the-counterdrugsatschoolotherthanasprovidedbydistrictpolicy.
Studentsshallnot:
