摘要: 《中华人民共和国海商法》明确规定了船舶碰撞的法律概念。然而, 在司法实践和理论研究中, 却存在着船
舶“直接碰撞”和“间接碰撞”的争论, 并由此导致了对同种事故的不同裁决。从文义解释、法律概念的生成及特征、立
法技术等角度, 运用比较、分析的方法对船舶碰撞的法律概念进行比较全面和深入的研究, 以期能够明确船舶碰撞
的法律概念, 对统一船舶碰撞法律适用、维护司法法律权威有所裨益。

A study on the legal concept of ship collision in China

Abstract: T he legal concept of ship co llisio n ha s been defined in the M aritime Code of the Peop le's Rep ublic of
China. In the related judicial practice and theo retical research, how ever, t here has been the controv ersy bet ween
“direct collision ”and “indirect collision ”o f ships w hich leads to different verdict s co ncerning t he sa me kind o f
accidents. In order to clarify the legal co ncept o f ship co llision, apply the law of ship co llisio n correctly a nd upho ld
the authority of law , the paper ex plores the leg al concept o f ship co llision by w ay o parativ e and analy tical study
and elaborate it from the perspectiv es of literal interpretation, fo rm atio n a nd characteristics o f legal concept as w ell
as leg islatio n techni
