摘要
在依法治国,建立法治国家的过程中,法治行政建设有着非常重要的地位和作用。近十几年来,中国法治行政建设有了长足的进步。特别是进入 1990 年代后,行政诉讼法、国家赔偿法、行政复议法、行政处罚法、立法法以及行政许可法颁布实施,在我国民主与法制建设进程中具有里程碑意义。但法治行政建设中存在的问题还不少。比如,立法膨胀问题,行政立法中的利益倾向问题,注重实体立法轻视程序立法问题,执法中以权压法、以权力压制和侵犯权利的问题等等。
本文试图从法治、法治行政的渊源开始,对法治行政建设过程中出现的问题进行分析,进而找出解决问题的方法与对策。论述了法治行政的基本内涵、主要特征、价值原则,以及法治行政的重要性,深入分析了法治行政建设中所面临的问题,并找出所面临问题的原因,最后提出一些推进行政法治化的具体策略。

ABSTRACT
In the rule of law, establish the country under the rule of law in the process of construction, the administrative takes a very important position and role. Nearly ten years, China’s law administrative construction had great progress. Especially in the 1990s, the administrative procedure law, after the pensation law, administrative reconsideration, the law on administrative punishments, the legislative law and the administrative licensing law enacted, in our democratic and legal construction milestone in the process. But the rule of the problems existing in the administrative construction is not little still. For example, legislation, administrative legislation expanding the interests, pay attention to entity legislation tendency to belittle program legislative issues, law enforcement in right pressure, power to suppress and infringe rights problems, etc.
