摘要:随着社会的发展,行政自由裁量权有扩大之势, 从行政自由裁量权自身的“自由”属性以及其他因素来看,存在着自由裁量权滥用的可能。行政自由裁量权的滥用,对行政法治是一个极大的威胁。因存在着权力的滥用和对公民权利的侵犯问题,因此,控制自由裁量权就显得必要。我国传统的控权措施主要有事后救济和实体控制两种,然而在自由裁量权范围和强度不断增加的情况,传统控制方式已难奏效。可行的方向就是建立自由裁量权的程序法控制机制。

Abstract: With the development of society, the discretionary power to have the potential to expand, but seem from the power itself ,the attribute-“freedom” make the abuse of the power discretion in administration possible, the abuse of the power of discretion administration is abig threat to realizing the rule of law in administration .There is lot of power and violation of civil rights have been abused ,so it is necessary to control the measures of China's traditional control are followed the after relief and main the scope and intensity of discretion increasing, the method of traditional control has been difficult to effective . It is feasible that we establish the procedural law to control the power of discretion as possible as we can.
