摘    要:
2017年是《企业破产法》实施十周年, 也是供给侧结构性改革的深化之年。在供给侧改革背景下, 破产审判工作在促进企业优胜劣汰市场化竞争、优化社会资源配置等方面发挥了不可替代的积极作用, 通过破产法律程序处置“僵尸企业”也成为供给侧改革的必由之路。目前, 在深化和推进供给侧改革进程中, 正确分析和切实解决当前我国破产审判工作中存在的具体问题, 总结经验, 研究举措, 努力为我国破产审判工作找到路径和方法, 是本文要旨所在。

2017 marks the tenth anniversary of the implementation of the Enterprise Bankruptcy Law and is also the deepening year for the supply-side structural reform. In the context of supply-side reform, the bankruptcy trial has played an irreplaceable and positive role in promoting the market-petition of the survival of the fittest, and optimizing the allocation of social resources.
