浅谈******罪的死刑废止问题
摘要:虽然我国刑法对******罪规定了死刑这种最严厉的刑罚,但******犯罪现象仍然严重,表明死刑对遏制这类犯罪的作用是有限的。因为刑罚的威慑力不仅仅是在于它的严厉性,更重要的在于它的确定性和可预期性。对******罪适用死刑同刑罚的公正、效益、人道价值追求之间存在一定程度的背离。废除******罪的死刑规定,有利于开展反***领域的国际合作,维护我国法制的统一和权威,也有利于保留证据,发现其他******犯罪,并对其他******犯罪人构成心理威慑,从而更加有利于打击******犯罪。但对******罪废除死刑的同时,需要进一步完善******罪的刑罚体系。

On the Abolition of the Death Penalty for the Crimes of Corruption and Bribery
Abstract:Although China's criminal law utilized the provisions of the death penalty on the crime of corruption and bribery which is the most severe penalty, the phenomenon of corruption and bribery is still serious. It shows that the death penalty for curbing such crimes is limited. Because the penalty's deterrent is not only on its stringent, but also on its certainty and predictability. Using the application of the death penalty on the crime of corruption and bribery departs from the value of justice, effectiveness and humanitarian. The abolition of the death penalty on corruption and bribery crimes is beneficial to the field of international anti-corruption cooperation, the safeguarding of China legal system’s unity and authority, the the preservation of evidence, the finding of other crimes of corruption and bribery, and also can put psychological deterrent on other crimes of corruption and bribery. Thereby it is more conducive to the fight against corruption and bribery. At the same time, we need to perfect the corruption and bribery crimes penalty system.

一、当前我国******罪的现状及成因
(一)我国******罪的现状
******罪,是指国家工作人员违反国家法律规定,利用职务之便,非法占有、使用公私财务,玷污国家工作人员职务行为的廉洁性的犯罪,也是国家工作人员利用职务便利实施的***犯罪的总称。
当前,随着改革开放的深入发展和市场经济体制的逐步建立,我国经济成分变得日趋复杂多样,由于社会分配不公现象的客观存在,社会成员之间的收益差异明显扩大,导致一部分人心理失衡,也刺激了经济犯罪分子的金钱欲望。相应地,******犯罪涉案金额越来越大,顶风作案现象也逐渐增多。前车之覆,本该成为后车之鉴,然而当今一些***犯罪者却不但不吸取前任者的教训,引以为戒,反而步其后尘,重蹈覆辙。这些年来,某些领导干部被查处后,继任者时隔不久东窗事发,锒铛入狱的情景已不罕见。[1 ] 林
