Abstract

Conducting the protection of Agriculture Geographical Indication is a good way to
promote the rural economy, increase the input of farmers as well as rationally develop
nature resource. However, the protection of Agriculture Geographical Indication has a
history of twentieth-eight year old. There are so many problems existing in the
protecting agricultural geographical indication. The study on it has a great meaning
and research value.
The protection of Agriculture Geographical Indication manifested in three aspects.
There is not clear legal provision. Besides, “Duplex Administer” system which is so
complex made applicant did not know how to adopt. What is more, the awareness of
protection of agriculture geographical indication is so weak. Farmers did not realize
that the protection of agriculture indication is a great project to be established.
Nowadays, their two-protection pattern existed in china, one is trademark pattern, and
the other is specialization geographical pattern. The author of this paper thinks that
the protection of Agriculture Geographical Indication is a long project to be
established. The agriculture geographical indication possessed the particular legal
factor. In the aspect of management research value, it has owned particular
administrative character. In the future, the protection of agriculture geographical
indication is a mechanism which can prompt the increase of farmers and the e.
The following three aspects should be done.
Firstly, legal and regulatory framework is necessary to regulate administration
system. I still adopt the “Trademark legislation” to protect agriculture indication
which can plement and perfect the preceding legislation.
Secondly, Chambers merce plays an important part in the protection of
agriculture protection. It can decrease the cost of government and conflict of
governments as well as save government resource.
