[摘要] 转化犯是刑法理论中的一个不大不小的问题。言其不大是因为转化犯仅是罪数理论中的一种犯罪形态。言其不小是因为刑法理论界对转化犯的概念、特征等诸多问题都有不同认识。理论界对转化犯的基本理论存在的分歧反映到个案中便是犯罪嫌疑人罪与非罪、此罪与彼罪、重罪与轻罪的差异。为了统一司法实践以便更好的实现刑法保障人权与惩罚犯罪的双重目的,刑法学界应当对转化犯的内涵与外延进行深层次的探讨。本文以刑法基础理论为认识手段、以现行刑法对转化犯的有关规定为认识对象对转化犯进行分析。

Abstract: The transformation violates is not a too big nor too small question in criminal law theory. It is not big because that the transformation violates is only one kind of quantity crime. it is not small because that the criminal law theorists have different understandings to the concept of the transformation violates、the characteristic and so on other questions. The criminal law theorists’ different understandings to the transformation violates reflect to the case is that the mit crime or non-crime, this crime or other crime, the grave offense or the misdemeanor .For unification judicature practice in order to the better realization of criminal law’s dual goals that safeguard human rights and tackle crimes, the criminal law theorists must do more research in the connotation and the extension of the transformation violates. This article takes the criminal law basic theory as the understanding tool, and the stipulation of the transformation violates as the understanding object.

一、转化犯的概念
(一)关于转化犯概念的不同观点
转化犯对于学****和研究刑法的人来说并不是一个陌生的概念。理论界对于转化犯诸多问题的认识莫衷一是,就连转化犯的概念都存在很多见解。归纳起来主要有以下几种观点:(1)转化犯是指由法律特别规定的,某一犯罪在一定条件下转化为另一种更为严重的犯罪,并且应当依照后一种犯罪定罪量刑的犯罪。[1]
